RESOLVED

That the Minutes of the meetings held on 9 July, 6 August (9.30am) and 6 August (10.30am) 2009 be confirmed and signed as correct records.

5          LICENSING ACT 2003: ‘SUPERVISION OF ALCOHOL SALES IN COMMUNITY PREMISES’ PROCEDURES

The Head of Natural and Built Environment submitted a report (Paper J81) outlining arrangements for integrating the Legislative Reform (Supervision of Alcohol Sales in Church and Village Halls etc) Order 2009 into Babergh District Council’s duties and procedures under the Licensing Act 2003, and recommending appropriate revisions to the Council’s Delegation Scheme.  He also referred Members to the extract for the Supplementary Guidance attached to the report as Appendix 2.

The new arrangements were generally welcomed by Members as being less onerous for Community establishments and bringing this aspect of licensing into line with the Club Premises Certificate system which applies to qualifying Members’ Clubs.  They noted the arrangements which would be made to publicise the new procedures and make available the application forms.

RESOLVED

(1)    That an amendment to the existing Licensing Act 2003: Scheme of Delegations in Part 3 of the Council’s Constitution be approved to provide for

         (a)     the determination of applications to disapply mandatory conditions at community premises relating to Designated Premises Supervisors and personal licence holders to be delegated to one of its Sub-Committees where Police representations are received and not withdrawn, and

         (b)     the determination of applications to disapply mandatory conditions at community premises relating to Designated Premises Supervisors and personal licence holders to be delegated to Officers where there are no Police representations     

         in accordance with the proposed updated Scheme attached as Appendix 1 to Paper J81.

(2)    That it be noted that where the request to disapply the mandatory conditions forms part of a new or variation application, or attracts representation as part of a review, those procedures and delegations shall apply.
