BABERGH DISTRICT COUNCIL LICENSING AND APPEALS COMMITTEE

MINUTES OF A MEETING OF THE LICENSING AND APPEALS COMMITTEE (TREES) HELD IN ST ANDREWS CHURCH HALL, CHELMONDISTON ON TUESDAY, 25 APRIL 2006

2 QUESTIONS FROM MEMBERS

3 TREE PRESERVATION ORDER NO. BT 400 – LAND ADJACENT TO FERNDALE COTTAGES, HOLLOW LANE, CHELMONDISTON

Prior to the meeting of the Committee, Members met at the site to view the trees covered by Tree Preservation Order No. BT 400.

In addition to the Members of the Committee, the following were present for the site visit:-

Mr S Ruffles (objector)

Mr D Carmichael, Arboricultural Officer

Mrs L Pattle, Admin Officer (Committees)

Following the site inspection, the Committee met to consider an objection to the Order dated 9 January 2006. Members had before them the following papers circulated with the Agenda for the meeting:-

Paper F11, including a copy of Tree Preservation Order No. BT 400 and a letter of objection dated 9 January 2006 submitted by Mr S Ruffles

Members noted that Mr Ruffles’ objection related only to the large Poplar (T1) covered by the Tree Preservation Order. In considering the objection to BT 400, the following were among the points noted:-

  • It was confirmed that the tree stood approximately 80 metres from an Area of Outstanding Natural Beauty, and less than 50 metres from the Chelmondiston Conservation Area at its nearest point.

  • Members accepted the Arboricultural Officer’s comments that the tree was of fine form with no obvious external indicators of decay, instability or disease.

  • It was noted that while the Order would provide protection, it would not preclude the owner from submitting an application to have the tree thinned. The Arboricultural Officer confirmed that he would monitor the tree from time to time, if requested to do so.

  • It was noted that the covering letter sent out with TPO 400 had incorrectly referred to the 1971 Town and Country Planning Act. It was confirmed that all future Notices would quote the 1990 Town and Country Planning Act.

RESOLVED

That Tree Preservation Order No. BT 400 be confirmed without modification.

The business of the meeting was concluded at 11.50 a.m.
