MINUTES OF A MEETING OF THE LICENSING SUB-COMMITTEE HELD IN COMMITTEE ROOM 1, COUNCIL OFFICES, CORKS LANE, HADLEIGH ON THURSDAY, 3 MARCH 2011 (9.30a.m.)

The Chairman of the Sub-Committee referred to the procedure to be followed at the Hearing, a copy of which had been circulated with the Agenda.
The Head of Natural and Built Environment submitted a report (Paper K210) requesting the Sub-Committee to determine an Application under the 2003 Licensing Act by Greene King Retailing Ltd. in respect of the Ram Public House, Market Place, Hadleigh.
Members then questioned the Head of Natural and Built Environment.
Mr J Buckingham presented his report and referred to Appendix C to Paper K210 which provided a summary of measures/licence conditions volunteered as part of the mediation discussions.
The objector then questioned Mr Buckingham.
Mr A Napier (Objector) presented his letter of objection contained in Appendix C to Paper K210. All parties present agreed to the circulation of additional comments in support of his representation from Mr Napier in the form of an e-mail dated 24 January 2011. The meeting was temporarily adjourned to enable all parties present sufficient time to be able to read the e-mail.
Mr Napier was then questioned by Members and the applicant.
The Applicants made an opening address to the meeting in support of the application and indicated that, following mediation with the Environmental Health Officer, they had agreed to a number of conditions.
The Applicants were then questioned by Members, Officers and the Objector.
All parties were then requested to provide closing comments to the meeting. Following this all parties withdrew to enable the Committee to deliberate the Application.
The relevant parties were then invited back into the meeting and the Council’s decision was notified.
RESOLVED
That the premises licence variation application be granted subject to mandatory conditions, conditions consistent with the operating schedule, and the following further conditions in order to promote the licensing objectives – and specifically the prevention of public nuisance. The further conditions in respect of the application made under the 2003 Licensing Act in respect of the Ram Public House, Market Place, Hadleigh are:-
(1) The conditions submitted within the operating schedule of variation application 006312 and those further agreed through mediation with the Council’s Principal Environmental Protection Officer. All of these conditions are summarised within Appendix C to Paper K210 and expressed as conditions of licence.
(2) That the existing licence restriction on timings of off-sales of alcohol shall continue to apply to the varied licence – being no off-sales after 23:00 hrs on a Monday to Saturday or after 22:30hrs on a Sunday.
(3) That the agreed cessation of any live music activity by 23:00 hrs on a Wednesday shall be extended to include the activities of ‘anything of a similar description to live music, recorded music or performance of dance’ (Box H of variation application 006312) and ‘provision of facilities for making music’ (Box I of variation application 006312). For the avoidance of doubt this condition will limit karaoke type activity to 23:00 hrs on a Wednesday.
(4) No alcohol shall be permitted to be taken off the licensed premises unless it is in a sealed container.
The business of the meeting was concluded at 11.00 a.m.
