It was noted that in accordance with Council Procedure Rule No. 5 a substitute was in attendance as follows:-

10      DECLARATION OF INTERESTS

Mr L S Johnson declared a prejudicial interest in Application No. B/09/00191 (Paper J30 - Item 1 - PDF 36Kb) as the applicant.  He stated that he would not participate except to speak for three minutes and after addressing the meeting he left the Chamber and was not present during consideration of the item.

RESOLVED

That the Minutes of the meeting held on 6 May 2009 be confirmed and signed as a correct record.

14      SITE INSPECTIONS

(1) That site inspections be held on Wednesday, 10 June 2009 in respect of the under-mentioned sites, prior to consideration of the applications by the Committee:-

Full Application – erection of single-storey front extension and erection of first floor front extension (following demolition of existing single-storey extension and front porch), 21 Stone Street.


Mr B H Hurren, Ward Member for Boxford, requested a site inspection to assess the impact of the development on the host building and the impact on the street scene.

Full Application – installation of floodlighting to ménage as amended by drawing no 1109-SKA2A and lighting proposal as received 8 May 2009, Crowe Hall, Lower Street.


Mr A J Ward, Ward Member for Alton, had previously (8 April 2009) requested a site inspection to assess possible light pollution and the visual impact.  The inspection could not take place earlier as the application was invalid, pending the receipt of further information/details.

Full application – Construction of 11 dwellings with associated garaging.  Construction of new vehicular access.  (Development to enable the restoration of the Listed Walled Garden and associated structures).

Listed Building Consent application – Restoration of the Walled Garden, including Garden Structures.  Paul Double Nurseries Ltd, Main Road.


The Chief Planning Control Officer requested a site inspection in view of the large number of site specific issues which have been identified in respect of the proposed development.

15      PLANNING APPLICATIONS FOR DETERMINATION BY THE COMMITTEE

Members had before them an Addendum to Paper J30 (PDF 113Kb) (circulated to Members prior to the commencement of the meeting) summarising additional correspondence received since the publication of the Agenda, but before 12 noon on the working day before the meeting, together with errata.

Details of further representations received in respect of Item Nos. 1, 4 and 6     were reported to the meeting and considered and taken into account before a decision was made in each case.

In accordance with the Council‘s procedure for public speaking on planning applications, representations were made as detailed below:-

That, subject to the imposition of conditions or reasons for refusal (whether additional or otherwise), in accordance with delegated powers under Council Minute No. 48(a) dated 19 October 2004, decisions on the items referred to in Paper J30 be made as follows:-

(a)    CAPEL ST MARY

Full Application – erection of single- storey extensions to north and south elevations, erection of single-storey porch extension, 1 Old Rectory Walk.

Notwithstanding the recommendation of the Chief Planning Control Officer to grant planning permission, a motion to refuse planning permission for reasons relating to policies HS33 and CN01 was moved but lost on being put to the vote.  Members were aware that the applicant had indicated his intention to provide a fence between the property and 3 Old Rectory Walk as Permitted Development, and expressed the view that it would be helpful if the fence could be provided at an early stage.

RESOLVED

(1) That planning permission be granted subject to the following condition:

  • Matching materials

(2) That an accompanying letter be sent with the decision notice  requesting that consideration be given to the early provision of the boundary fence.

Full Application – variation of Condition 2 attached to planning permission B/02/01313 to allow an additional 27 caravans to be stationed on site, and to reduce the number of touring caravans/camping pitches during the period 1 February to 2 January, together with internal road.  Alterations and reoccupation of the relinquished first floor manager’s flat for the use by the Groundsman (use of the static pitch as accommodation for full-time Groundsman to be relinquished), The Grange Caravan Park, Straight Road.

RESOLVED

That planning permission be granted subject to the following conditions:

  • Standard Time Limit
  • Landscaping Scheme
  • Use of static caravan for full time Groundsman to be relinquished
  • First floor flat to only be occupied by full time Groundsman and dependants
  • No external lighting without prior approval of the local planning authority

Full Application – erection of a single-storey rear extension (insertion of side window and rear rooflight) 58 Bear Street.

Notwithstanding the recommendation of the Chief Planning Control Officer to refuse planning permission, a motion for approval was proposed but not seconded.

RESOLVED

That planning permission be refused for the following reason:

The proposed single-storey rear extension is contrary to the provisions of policies CN08 and HS33 of the Babergh Local Plan Alteration No.2 (2006) which seek, inter alia, to ensure that extensions to residential properties preserve and enhance the character of the Conservation Area and result in sufficient space remaining available to park vehicles in the curtilage of the dwelling.  The proposed extension erodes the existing parking and turning area to the rear of the property, thereby resulting in insufficient parking space within the curtilage of the property to serve the extended dwelling.  The loss of this parking space would exacerbate the need for on-street parking where there is already significant pressure for such parking provision on the road, to the detriment of the character of the Conservation Area and highway safety.

RESOLVED

That planning permission be granted subject to the following conditions:

  • Hours of operation
  • Angle of lights
  • Provision of shielding
  • The sets of lights only to be used independently of each other
  • As recommended by LHA

Full Application – erection of 2 two-storey detached dwellings.  Construction of vehicular access and 4 car parking spaces, land south and west of 1 Palfrey Heights.

RESOLVED

(1) That the Solicitor to the Council be authorised to secure a Planning Obligation under Section 106 of the Town and Country Planning Act 1990 to provide:

  • Financial contribution towards Public Open Space provision

(2) That, subject to the completion of the Planning Obligation referred to in Resolution (1) above to the satisfaction of the Solicitor to the Council, the Chief Planning Control Officer be authorised to grant planning permission subject to the following conditions:

  • Standard Time limit
  • Submission of material samples
  • Parking spaces to be retained for parking of vehicles at all times.
  • Removal of Permitted Development Rights for further extensions and for insertion of new openings above ground floor level.
  • Landscaping scheme
  • Details of boundary treatment

(3) That in the event of the Planning Obligation referred to in Resolution (1) above not being secured, the Chief Planning Control Officer be authorised to refuse planning permission for the following reason:

  • Lack of financial contribution towards Public Open Space provision.

16      DRAFT ANNUAL REPORT OF DEVELOPMENT COMMITTEE FOR 
           2008/09

The Chief Planning Control Officer submitted a report (Paper J31 (PDF 228Kb)) summarising the work of the Development Committee for the year 2008/09.  Members were asked to adopt Paper J31, subject to any amendments they wished to make following their consideration of the report and its Appendices, for submission to the Overview and Scrutiny (Community Services) Committee.  Members note that the Appendices to Paper J31 would be updated with such information as becomes available prior to the dispatch of the Committee agenda.

RESOLVED

That Paper J31 be adopted as the Annual Report of the Development Committee for 2008/09 and submitted to the Overview and Scrutiny (Community Services) Committee on 30 June, subject to a minor amendment to clarify paragraph 5.2 of the report.


Notes

1. Mrs C Thurlow, Development Control Manager was not present at the meeting during consideration of Application No B/08/01522 (Item 3 of Paper J30).

2. In relation to Application No B/09/0031 (Item 5 of Paper J30), Members were advised that the Affordable Housing Scheme proposed by the Application is the subject of a recommendation by the Council’s Housing Panel for the Scheme to be included in the Council’s approved Affordable Housing Programme.  The relevant report and recommendation will be considered by the Strategy Committee and the Council on 18 June and 14 July 2009 respectively.

3. The meeting was adjourned between 10.50 a.m. and 11.15 a.m. for refreshments.
