92 DECLARATION OF INTERESTS
Mr P J Holbrook declared a personal interest in Application Number B/06/00029 (Paper E283 – Item 2) by virtue of the fact that one of the objectors is known to him as he is a member of Bures St Mary Parish Council, but indicated that his interest was such that he was able to speak and vote on the matter concerned.
Mr B D Hurren declared a personal interest in Application Number B/05/01524 (Paper E283 – Item 5) by virtue of being the Chairman of Pin Mill Task Group, but indicated that his interest was such that he was able to speak and vote on the matter concerned.
Mr P Jones and Mr D C Rose declared personal interests in Application Number B/05/01524 (Paper E283 – Item 5) by virtue of their membership of the Pin Mill Task Group, but indicated that their interest was such that they were able to speak and vote on the matter concerned.

RESOLVED
That the Minutes of the meeting held on 1 February 2006 be confirmed and signed as a correct record subject to Minute No. 85 being amended to read “Mr D C Rose declared a personal interest in Application Number B/05/02103 (Paper E258 – Item 16) by virtue of the fact that the applicant is a member of Holbrook Parish Council, but indicated that his interest was such that he was able to speak and vote on the matter concerned.”

Notwithstanding the recommendation of the Head of Planning (Control) to grant planning permission, a motion of refusal was moved because Members considered the proposal to be over development that would result in the loss of amenity and have a detrimental effect on the street scene. On being put to the vote this motion was lost.

That outline planning permission be granted subject to the following conditions:-

(d) CHELMONDISTON

Full Application – erection of 2 No. jetties and shed, (as amended by revised plans received on 5 December 2005 to show revised position of jetty and shed, and as further amended by Certificate B received on 20 January 2006 and by fax details received on 11 January 2006), Barge Pandora, The Barges, Pin Mill.

Notwithstanding the recommendation of the Head of Planning (Control) to grant planning permission, a motion of refusal was moved because Members considered the size and siting of the proposed shed to be contrary to Policy CR28. Members were also concerned that the erection of a second jetty to the rear of an existing jetty would have an adverse impact on the residential amenity of the adjacent barge (Adrianto).
RESOLVED
That planning permission be refused for the following reasons:-
- contrary to Policy CR28 - detrimental to residential amenity

Full Application – conversion of stable building to dwelling with internal and external changes (alterations to scheme approved under planning permission B/04/2065/FUL). Erection of two-storey side and front extensions, stables and land at Westgate Street.

Members noted that it had been confirmed that a formal diversion of Public Footpath No.25 (not 18 as shown in the Report) would be required. A note to the effect that approval for the diversion must be obtained by the applicant before works connected with the grant of planning permission could be commenced would be attached to the grant of planning permission.
RESOLVED
That subject to no new material issues being raised prior to the expiry of publicity periods and by any outstanding consultees, the Head of Planning (Control) be authorised to grant planning permission subject to the following conditions:-
- materials and detailing - alternative to planning permission B/04/2065/FUL - any as required in relation to outstanding consultees
98 REQUEST FOR A MINOR AMENDMENT TO APPLICATION REFERENCE B/05/00545/FUL – ERECTION OF DETACHED TWO-STOREY DWELLING WITH ATTACHED GARAGE, PLOT 1, SCOSSELS, GLEMSFORD
The Head of Planning (Control) reported that planning permission was granted for the above development on 3 May 2005. Work on site had commenced, and the building had not been positioned in the approved siting.
A proposed minor amendment has been submitted to regularise the unauthorised siting and amend the design of the property in order to mitigate against any adverse impact on the neighbouring properties.
RESOLVED
That the minor amendment to B/05/00545/FUL in respect of the erection of a two-storey dwelling at Plot 1, Scossels, Glemsford be approved.
99 PLANNING APPLICATIONS FOR DETERMINATION BY THE COMMITTEE
RESOLVED

Full Application – erection of detached dwelling. Alterations to existing vehicular access, part rear garden of Pilgrims Rest.

Notwithstanding the recommendation of the Head of Planning (Control) of approval, a motion to refuse planning permission was moved because Members were concerned that the height of the proposed dwelling and the elevated nature of the site would lead to unacceptable levels of overlooking, and therefore have a detrimental impact on the residential amenity of the occupiers of 2 Town Hill, St Edmunds Lane.
RESOLVED
That planning permission be refused for the following reason:-
- the height of the proposed dwelling and the elevated nature of the site would lead to unacceptable levels of overlooking, and therefore have a detrimental impact on the residential amenity of the occupiers of 2 Town Hill, St Edmunds Lane.

RESOLVED
That subject to the receipt of amended plans, together with a date for the implementation of a passing bay and a favourable response from the County Highway Authority upon reconsultation of the amended plans, the Head of Planning (Control) be authorised to grant planning permission, subject to the following conditions:-

(c) GREAT CORNARD

Outline Application – erection of up to 30 No. dwellings with garages and parking. Construction of new vehicular access onto Head Lane, land to rear of 41 – 69 Head Lane, together with 69 Head Lane.

Mr P K Beer, Ward Member for Great Cornard (South), requested a site visit to enable Members to assess the suitability of the access to the proposed development, and also consider the impact upon the residential amenity of the neighbours.
RESOLVED
(1) That consideration of the recommendation of the Head of Planning (Control) contained in (c) above be deferred.
(2) That a site inspection be held on Wednesday, 8 March 2006, that the Panel of Members appointed under Minute 96 above inspect the site, and that a report thereon be submitted to the next meeting of the Committee, if appropriate.
100 REQUEST FOR A MINOR AMENDMENT TO APPLICATION REFERENCE B/05/00326/RES – SUBMISSION OF DETAILS UNDER OUTLINE PLANNING PERMISSION B/01/00580/OUT – THE SITING, DESIGN AND THE EXTERNAL APPEARANCE OF AND THE LANDSCAPING OF THE SITE FOR THE ERECTION OF 2 NO. DETACHED DWELLINGS. VARIATION OF CONDITION 03 OF OUTLINE PLANNING PERMISSION B/01/00510/OUT TO ENABLE AN AMENDED PARKING AND MANOEUVRING AREA TO BE PROVIDED, ST MARY’S, HIGH STREET, BURES ST MARY
The Head of Planning (Control) reported that planning permission had been granted for the erection of 2 No. detached dwellings in the garden of St Mary’s, High Street, Bures St Mary on 27 April 2005.
The proposed minor amendment involves alterations to the windows, doors and garage of both Plots 1 and 2. The minor amendment had been the subject of recent consultation, and comments had been received from the Parish Council and the local Member.
A motion to agree the minor amendments to B/05/00326/RES in respect of the erection of 2 No. detached dwellings in part rear garden of St Mary’s, Bures St Mary with the added condition of obscure glass in the roof lights was moved, but upon being put to the vote, this was lost.
RESOLVED
That the minor amendment to B/05/00326/RES in respect of the erection of 2 No. detached dwellings in part rear garden of St Mary’s, Bures St Mary be not agreed as Members did not consider the significant increase in roof height on the revised plans to be a minor amendment.
101 REQUEST FOR A MINOR AMENDMENT TO APPLICATION REFERENCE B/05/00749/FUL – THE ERECTION OF TWO-STOREY DETACHED DWELLING – PART REAR GARDEN OF RICHMOND LODGE, 13 KINGS HILL, GREAT CORNARD
The Head of Planning (Control) reported that planning permission was granted for the erection of a two-storey dwelling in the garden of Richmond Lodge on 22 June 2005.
The proposed minor amendment involves the addition of 3 No. roof lights in respect of the north elevation and following a period of reconsultation, a recommendation of refusal had been received from the Parish Council and a letter objecting to the insertion of roof lights.
The proposed changes are minimal in visual terms, and should not give rise to any adverse impact on neighbour amenity, given the content of the approved scheme. There is also no objection to the additional roof lights on the north elevation in visual terms and it is not considered that these will adversely impact on the objector’s property (1 Schofield Court).
RESOLVED
That the minor amendment to B/05/00749/FUL in respect of the erection of a two-storey dwelling in part rear garden of Richmond Lodge, 13 Kings Hill, Great Cornard be approved.
102 EXCLUSION OF THE PUBLIC (WHICH TERM INCLUDES THE PRESS)
RESOLVED
That pursuant to Section 100A(4) of the Local Government Act 1972, the public be excluded from the meeting for the business specified below, on the grounds that if the public were present during this time, it is likely that there would be the disclosure to them of exempt information, as indicated against the item. Further, that Members were satisfied that in all circumstances the public interest in maintaining confidentiality outweighed the public interest in disclosing the information.
103 ARTICLE 4 DIRECTION, LAND BETWEEN KINGSLAND LANE AND LOCKS LANE NAYLAND (Exempt information by virtue of Paragraph 6 of Part 1 of Schedule 12A of the Local Government Act 1972)
The Head of Planning (Control) and the Acting Head of Legal and Administrative Services, submitted a joint report (Paper E284) advising Members of a parcel of land within the parish of Nayland that was being offered for sale as building plots.
The carrying out of “permitted development” on these vacant plots would severely detract from the character of the area, and it was therefore recommended that Article 4(1) Directions be made which would have the effect of withdrawing certain permitted development rights.
RESOLVED
That the Solicitor to the Council be authorised to make and issue Article 4(1) Directions in the terms identified in paragraphs 4.4.2 and 4.4.4 of Paper E284.
