MINUTES OF A MEETING OF THE DEVELOPMENT COMMITTEE HELD IN THE COUNCIL CHAMBER, COUNCIL OFFICES, CORKS LANE, HADLEIGH ON WEDNESDAY, 12 OCTOBER 2005

Mr C J Hunt, Ward Member for Nayland was present at the meeting for item number 11 of Paper E165 and spoke on the item with the consent of the Chairman.


54                DECLARATION OF INTERESTS

 

Mr A J Hinton declared a personal interest in application No. B/05/01547 (Paper E165– Item 13) by virtue of his position as Chairman of East Bergholt Parish Council and confirmed that his interest was such that he was able to speak and vote on the matter concerned.

 

Mrs E F Bates declared a prejudicial interest in application No. B/05/00589/RES by virtue of her son being employed by the applicant’s agent, and withdrew from the meeting during consideration of the item.

 

55            MINUTES

 

RESOLVED

 

That the Minutes of the meeting held on 14 September 2005 be confirmed and signed as a correct record.

 

56            PETITIONS

 

The Acting Head of Legal and Administrative Services reported that in accordance with Council Procedure Rule No. 13 a petition had been submitted to the Chief Executive relating to:-

 

Application No: B/05/1487/FUL – Erection of one No. two storey dwelling with attached double garage and two No. bungalows with two No. detached single garages (existing dwelling to be demolished).  Construction of new vehicular access, 77 High Road, Leavenheath. (Signed by approximately 104 residents). 

 

Members noted that in accordance with the Procedure Rules, the Chief Executive would report the receipt of the petition to the Council meeting on 18 October 2005.

SHIMPLING

Outline Application – erection of 12 No. dwellings and construction of vehicular access and provision of amenity land (woodland), (existing buildings to be demolished)  The Croft, Gents Lane. 

 

Mr A E Pearce, Ward Member for Sudbury (East) considered the site to be exceptional and had requested a site inspection to enable members to decide whether it would be classed as a brownfield site on the edge of the village.

Mr C W Arthey, Ward Member for  North Cosford requested a site inspection to enable Members to familiarise themselves with the site given its location in a Conservation Area and adjacent to a listed building, and to assess the potential impact upon the neighbouring properties.

         Paper E165 – Item 17

 

 

 

 

Reserved Matters – submission of details under Outline Planning Permission Ref. B/01/1747/OUT – the siting, design and the external appearance of, and the landscaping of the site for the erection of industrial/commercial development – Classes B1, B2 and B8 and construction of vehicular/pedestrian access, land at County Farm (East) Fronting, Church Field Road.

 

Mr A E Pearce, Ward Member for Sudbury (East) requested a site inspection to enable Members to assess the site from areas not previously visited i.e. the footpaths and the nearby listed building and garden. 

 

RESOLVED

 

(1)     That consideration of the recommendations of the Head of Planning (Control) contained in (b) and (c) above be deferred.

 

(2)     That it be noted that, in relation to (c) above, consideration of this application has been deferred by the Head of Planning (Control), in consultation with the Chairman, due to the applicant being incorrectly advised as to the availability of the Committee reports and which the applicant claimed had prejudiced their position.

 

(3)     That site inspections be held on Wednesday, 19 October 2005, that the Panel of Members appointed under Minute 58 above inspect the sites, and that reports thereon be submitted to the next meeting of the Committee, if appropriate.

Outline Application – erection of buildings for production of mushrooms, land adjacent Stour Valley Nurseries, Martins Hill Farm, Bergholt Road.

That it be noted that consideration of this application has been deferred by the Head of Planning (Control), in consultation with the Chairman, due to the applicant being incorrectly advised as to the availability of the Committee reports and which the applicant claimed had prejudiced their position.

         Paper E165 – Item 7

 

 

Full Application – reconstruction and extension of mill base to create 1 no. dwelling.  Erection of detached garage.  Revised design of Class B1 business units (alternative to planning permission B/03/1102/RES).  As amended by plans received 21/4/2005, 31/8/2005 and 14/9/2005,  Elmsett Mill, Whatfield Road.

 

RESOLVED

 

That the Head of Planning (Control) be authorised to grant planning permission subject to the condition outlined in Item 7 of Paper E165.

 

 

(h)     ELMSETT

 

         Application No. B/05/01582

         Paper E165 – Item 9

 

 

Outline Application – erection of 1 no. detached dwelling with access onto existing vehicular access, propane storage site, Ipswich Road.

 

 

Notwithstanding the recommendation of the Head of Planning (Control) to refuse outline planning permission, a motion to grant planning permission was moved because Members considered the proposal to be efficient use of the brownfield site and not contrary to PPG3.  They also considered that the recommendations of the County Highway Authority to improve the visibility splay could be carried out without significant adverse impact on the trees on the site.

 

RESOLVED

 

That planning permission be granted, subject to the following condition:-

 

·              As recommended by County Highway Authority.

 

 

(i)      NAYLAND

 

         Application Nos. B/05/01646 and

         B/05/01647 (CAC)

         Paper E165 – Item 11

 

 

Full and Conservation Area Consent-  Erection of detached two-storey dwelling and attached carport (following demolition of existing dwelling).  Construction of new vehicular access.  Demolition of existing two-storey dwelling, 21 Court Street.

 

Members noted that the Head of Building Control had visited the site and had confirmed that the building could not be retained without entire refurbishment/repair.

 

RESOLVED

 

(1)       That subject to no new issues being raised as a result of the ongoing consultation exercise, the Head of Planning (Control) be authorised to grant planning permission in respect of Application B/05/01646/FUL subject to those conditions he deems appropriate, but to include:-

 

·           Materials

·           As recommended by County Highway Authority (as appropriate)

·           Removal of PD rights for additional fenestration above ground floor level

·           Full details of proposed conservation rooflights.

 

(2)       That subject to no new issues being raised as a result of the ongoing consultation exercise, conservation area consent be granted.

          Paper E165 – Item 16

         

 

 

Conversion of former farm buildings into one dwelling and alteration to existing vehicular accesses, Mile End Farm Barn, Somerton Road.

 

 

Members noted that a survey had been carried out and no evidence of bats had been found on the site.

 

RESOLVED

 

That the Head of Planning (Control) be authorised to grant planning permission subject to the following conditions:-

 

·                    Permitted development rights removed regarding extensions, outbuildings, screen walls and fencing and roof extensions/alterations.

That planning permission be granted subject to the conditions as contained in Item 8 of Paper E165.

          Application No. B/04/01825

          Paper E165 – Item 10

 

 

Full Application – retention of two No. mobile homes, (accommodation used by farm stockmen).  As amended by letter received 8 February 2005 to delete student visitor centre from application, Pannington Hall Farm, Pannington Hall Lane.

That planning permission be granted subject to the conditions contained in Item 10 of Paper E165.

 

 

(n)      SHOTLEY

 

          Application No. B/05/01544

          Paper E165 – Item 12

 

 

 

Full Application – erection of one pair of two-bedroom semi-detached bungalows and one pair of two bedroom and three bedroom semi-detached bungalows (existing dwellings to be demolished) and associated garden sheds, 11 and 13 Queensland.

 

RESOLVED

 

That the recommendation of the Head of Planning (Control) contained in Item 12 of Paper E165 be adopted.

 

 

(o)      EAST BERGHOLT

 

          Application No. B/05/01547

          Paper E165 – Item 13

 

 

Full Application – erection of two-storey detached dwelling.  Construction of new vehicular access, land adjacent No. 3 Burnt Oak Corner, Gandish Road.

 

RESOLVED

 

That the recommendation of the Head of Planning (Control) contained in Item 13 of Paper E165 be adopted.

 

 

(p)      CHATTISHAM

 

          Application No. B/05/01476

          Paper E165 – Item 14

 

 

The extension and conversion of triple garage to form 1 No. detached dwelling.  Alteration to existing vehicular access, part side garden of Sunnyside, The Street.

 

Notwithstanding the recommendation of the Head of Planning (Control) to grant planning permission, a motion of refusal was moved because Members considered the proposal to be over development of a site outside any identified village and also an unsustainable development contrary to Local Plan Policies.

 

RESOLVED

 

That planning permission be refused for the following reasons:-

 

·                    Overdevelopment of site.

·                    Outside built up area boundary

·                    Unsustainable development

·                    Contrary to policies   CS1, CS3, ENV6, LP4, LP17, HS02, HS04 and HS12

 

(q)      NAYLAND

 

          Application No. B/05/01576

          Paper E165 – Item 15

 

 

Outline Application – erection of 2 no. detached two-storey dwellings with detached garages, part side garden No. 29 Heycroft Way.

 

Notwithstanding the Head of Planning (Control)’s recommendation of approval, a motion to refuse planning permission was moved because Members considered the site to be outside the built up area boundary and could therefore set an undesirable precedent for further unrelated sporadic development in the open countryside.  On being put to the vote, this was lost.

 

RESOLVED

 

That subject to no new material planning considerations being raised as a result of the public consultation exercise and no objections being raised by the County Highway Authority, the Head of Planning (Control) be authorised to grant outline planning permission subject to the following conditions:-

 

·                    Reserved matters

·                    Materials

·                    As recommended by County Highway Authority

·                    Boundary treatment

·                    Protection of trees and hedgerows during construction

·                    Landscaping scheme

·                    Removal of PD Rights for enlargements, alterations and outbuildings.

 

60            SUDBURY HERITAGE ECONOMIC REGENERATION SCHEME: PROPOSED GRANT FOR 48 NORTH STREET

 

The Acting Head of Planning Policy and Economic Development submitted a report  (Paper E164) concerning a proposed HERS grant towards eligible brickwork and window repair works at 48 North Street, Sudbury.

 

RESOLVED

 

That the offer of a grant of £9,338 towards the works set out in Paper E164 at 48 North Street, Sudbury be approved.       

 

61            REQUEST FOR A MINOR AMENDMENT TO APPLICATION REF. B/04/02123/FUL – ERECTION OF 2 NO. TWO-STOREY DETACHED DWELLINGS WITH ASSOCIATED DETACHED GARAGES.  CONSTRUCTION OF NEW VEHICULAR ACCESS – PART SIDE GARDEN OF INNISFREE, THE CAUSEWAY, HITCHAM

 

The Head of Planning (Control) reported that planning permission was granted for the above development on 6 June 2005.  A proposed minor amendment was received on 22 August 2005 and involves alterations to fenestration details in respect of both dwellings.  The changes are minimal in visual terms and should not give rise to any adverse impact on neighbouring amenity given the content of the approved scheme.

 

RESOLVED

 

That the minor amendments to planning permission B/04/02123/FUL in respect of the erection of 2 No. two-storey dwellings in part side garden of Innisfree, Hitcham be approved.

 

Note: The meeting was adjourned between 11.05 a.m. and 11.35 a.m. for refreshments.
