64        MINUTES

RESOLVED

That the Minutes of the meeting held on 16 December 2008 be confirmed and signed as a correct record.

65        DECLARATION OF INTERESTS

Mr G S White declared a personal interest in the item referred to in Minute No.67 below by virtue of being a Member of the South Suffolk Leisure Trust Board and the Ipswich and District Citizens Advice Bureau but indicated that his interest was such that he would be able to speak and vote on the matter concerned.

Mr C M Spence declared a personal interest in the item referred to in Minute No.67 below by virtue of being a Member of Suffolk County Council but indicated that his interest was such that he would be able to speak and vote on the matter concerned.

Mrs J Antill declared a personal interest in the item referred to in Minute No.67 below by virtue of being a Director of the Sudbury and District Citizens Advice Bureau and a Governor of the Gainsborough House Society but indicated that her interest was such that she would be able to speak and vote on the matter concerned.

Mr R E Kemp declared a personal interest in the item referred to in Minute No.67 below by virtue of being a Member of Suffolk County Council and a Director of the Sudbury and District Citizens Advice Bureau but indicated that his interest was such that he would be able to speak and vote on the matter concerned.

Mr P K Beer declared a personal interest in the item referred to in Minute No.67 below by virtue of being a Member of Suffolk County Council but indicated that his interest was such that he would be able to speak and vote on the matter concerned.

Mr D G Grutchfield declared a personal interest in the item referred to in Minute No.67 below by virtue of being a Member of Suffolk County Council but indicated that his interest was such that he would be able to speak and vote on the matter concerned.

Mr B L Lazenby declared a personal interest in the item referred to in Minute No.67 below by virtue of being a Member of the South Suffolk Leisure Trust but indicated that his interest was such that he would be able to speak and vote on the matter concerned.

Mr B D Hurren declared a personal interest in the item referred to in Minute No.67 below by virtue of being a Member of the Board of The Quay Theatre, Sudbury, but indicated that his interest was such that he would be able to speak and vote on the matter concerned.

66        TO RECEIVE NOTIFICATION OF PETITIONS IN ACCORDANCE WITH 
            COUNCIL PROCEDURE RULE NO. 13

In accordance with Council Procedure Rule No. 13, it was noted that the following petitions had been received:

North Street Car Park, Sudbury

Petition signed by approximately 1000 residents in support of Siam Surgery staff being allowed to use North Street Car Park, Sudbury for excess of the 3 hour limit during surgery opening hours.

The petition was reported to the Strategy Committee on 12 February 2009 who asked for the Head of Contract and Asset Management to submit a report to a future meeting.

Application No. B/08/01785 – Retention of Access Gates and Gate Posts, 11 Water Street, Lavenham

(a)     Petition dated 22 January 2009

Signed by approximately 26 residents requesting that the application be determined by the Development Committee.

The petition was reported to the Development Committee at its meeting on 11 February 2009 when it was noted that the application had already been determined under the delegated powers, and the decision issued, prior to receipt of the petition.

(b)     Petition dated 29 January 2009

Signed by approximately 53 residents objecting on the basis that the planning application was not taken to the Development Committee.  The petition was accompanied by a letter which will be replied to through the Council’s normal complaints’ procedure.

The petition was reported to the Development Committee at its meeting on 11 February 2009.  Members asked to be kept informed of the response to the issues raised.

67        BUDGET 2009/10

The Chairman of the Strategy Committee, Mr N A Ridley, introduced this item and read a prepared budget statement to the Council.  A copy of the statement was made available at the meeting. 

Members had before them a report by the Director of Finance (Paper H201) together with the Policy and Budget Framework document appended to the report.  It was noted that the precept of the Suffolk Police Authority had been approved at a meeting on 23 February 2009. Circulated at the meeting was the updated level of Council Tax for all Parishes in the Babergh District (all bands) for 2009/10, which would be incorporated into recommendation 11 of Paper H201.

It was noted that the figures referred to in recommendation 9(a) of Paper H201 should be amended to £53,749,290 and the figure in 9(b) to £41,197,850.

The Council was asked to pass the necessary resolutions in relation to the Budget and to the making and collection of Council Tax for 2009/10 as set out in Paper H201 and the relevant appendices to that report.

(1)          That the Budget set out in the attached Policy and Budget Framework 2009/10, including the prudential indicators for capital finance and treasury management and the Minimum Revenue Provision policy statement and the Budget Risk Assessment, be approved.

(2)          That the revised General Fund charges are implemented with effect from 1 April 2009.

(3)          That the weekly rents for Council’s dwellings and compulsory let garages be increased on average by 6.7% and in accordance with the rent restructuring requirements with effect from Monday, 13 April 2009.

(4)          That the revised Council housing charges, including the rents for garages and car ports which are not compulsorily let with dwellings are implemented with effect from Monday, 13 April 2009.

(5)          That where expenditure is included within the approved budget, the Director of Finance be empowered to:-

  • Vary the timing of revenue and capital payments from the current financial year to 2009/10 or vice-versa in accordance with Financial Regulations and Council resolutions.
  • Vary the method of financing capital schemes, if he is satisfied that it is in the financial interest of the Council to do so.

(7)     That the Director of Finance be authorised to make any necessary adjustments to the attached Policy and Budget Framework 2009/10 document following approval of the budget.

(8)     That it be noted that, the Director of Finance has calculated the following amounts, in accordance with regulations made under Section 33(5) of the Local Government Finance Act 1992:-

32,830.67 being the amount calculated by the Council, in accordance with Regulation 3 of the Local Authorities (Calculation of Council Tax Base) Regulations 1992, as its Council Tax Base for the year 2009/10.

That the relevant amounts for each part of the Council’s area be as follows:

being the amounts calculated by the Council in accordance with Regulation 6 of the Regulations, as the amount of its Council Tax Base for the year for dwellings in those parts of its area to which one or more special items relate.

(9)     That the following amounts be now calculated by the Council for the year 2009/10 in accordance with Sections 32 to 36 of the Local Government Finance Act 1992:

(a)    £53,749,290 being the aggregate of the amounts which the Council estimates for the items set out in Section 32(3) (a) to (e) of the Act.

(b)    £41,197,850 being the aggregate of the amounts which the Council estimates for the items set out in Section 32(3) (a) to (c) of the Act.

(c)    £12,551,440 being the amount by which the aggregate at 9(a) above exceeds the aggregate at 9(b) above, calculated by the Council, in accordance with Section 32(4) of the Act, as its budget requirement for the year.

(d)         £6,101,300 being the aggregate of the sums which the Council estimates will be payable for the year into its general fund in respect of redistributed non-domestic rates, revenue support grant, and additional grant or special grant increased by the amount of the sums which the Council estimates will be transferred in the year from its Collection Fund to its General Fund in accordance with Section 97(3) of the Local Government Finance Act 1988 (Council Tax Surplus) and increased by the amount of any sum which the Council estimates will be transferred from its Collection Fund to its General Fund pursuant to the Collection Fund (Community Charges) directions under Section 98(4) of the Local Government Finance Act 1988 made on 7 February 1994 (Community Charge Surplus) and reduced by the amount representing the authority's contribution to Council Tax benefit resulting from an increase in its Council Tax calculated in accordance with the Collection Fund (General) (England) Directions 2000, the Collection Fund (Council Tax Benefit) (England) Direction 2000 the Local Authorities (Alteration of Requisite Calculations) (England) Regulations 2000 and the Collection Fund (adjustments for previous years) (England) Directions 2000.

(e)     £196.47 being the amount at 9(c) above less the amount at 9(d) above, all divided by the amount at 8(a) above, calculated by the Council, in accordance with Section 33(1) of the Act, as the basic amount of its Council Tax for the year.  

(f)     £2,019,400 being the aggregate amount of all special items referred to in Section 34(1) of the Act.

(g)         £134.96   being the amount at 9(e) above less the result given by dividing the amount at 9(f) above by the amount at 8(a) above, calculated by the Council, in accordance with Section 34(2) of the Act, as the basic amount of its Council Tax for the year for dwellings in those parts of its area to which no special item relates.

being the amounts given by multiplying the amounts at 9(g) and 9(h) above by the number which, in the proportion set out in Section 5(a) of the Act, is applicable to dwellings listed in a particular valuation band divided by the number which in that proportion is applicable to dwellings listed in valuation Band D, calculated by the Council, in accordance with Section 36(1) of the Act, as the amount to be taken into account for the year in respect of categories of dwellings listed in different valuation bands.

(10)   That it be noted that for the year 2009/10 the major precepting authorities have stated the following amounts in precepts issued to the Council in accordance with Section 40 of the Local Government Finance Act 1992, for each of the categories of dwellings shown below:-

(12)   That in respect of Council Tax and Business Rates the ten instalment dates each year should be the 1st of each month from the 1st April to 1st January, but with the ability for Council Taxpayers who elect to pay by Direct Debit to choose between the 1st, 8th, 15th, 22nd and 28th of each month; subject to the proviso that the payment date of the 1st of each month can be revised to a later date by the Director of Finance, in consultation with the Chairman of the Strategy Committee, if it is felt to be essential to do so.

(c)           to institute any other legal proceedings, process or steps for the purpose of recovering any such unpaid Council Taxes and Penalties and to appear on behalf of the Council at any Hearing relating thereto.

70    REPORT OF THE INDEPENDENT REMUNERATION PANEL (IRP) FOR THE BABERGH DISTRICT – REVIEW OF THE MEMBER’ ALLOWANCES SCHEME FOR THE PERIOD FROM 1 MAY 2009

The Director of Corporate Service reported that the IRP has carried out a review and its report was submitted as Paper H202.

The Panel Members previous report, on which the existing Members Allowances Scheme is based, was made to the Council in February 2007.

In the light of continuing uncertainty around LGR the Panel has not undertaken a major review of the scheme although this would obviously be required if, for instance, the outcome of LGR is for the status quo in Babergh.  The Panels conclusions are that the IRP headline rate of inflation should be applied for a further period.  Other findings of the IRP were outlined in paragraph 2 of the report.

RESOLVED

(1)          That subject to recommendation (3) below (concerning inflation) the base rate for the following allowances (adopted by the Council in 2007) remains the same:

(a)          Basic Allowance

(b)         Special Responsibility Allowances

(c)          Dependants’ Carers’ Allowance

(d)         Co-optees’ Allowances

(2)          That the Childcare Allowance continues to coincide with the SCC Childminder Rate.

(3)          That all Allowances payable under the Scheme be revised in line with changes in the RPI headline rate of inflation, being the RPI as for the month of March immediately preceding the relevant review date, until the Scheme is next reviewed or until 30 April 2011, whichever is the earlier, subject to there being no reduction in the rates current at the relevant date in the event that the March RPI for the year in question falls below 0%.

(4)          That Travel and Subsistence Allowances continue to be revised to accord with those payable to Council employees from time to time with the exception of overnight absences which increase in line with RPI in accordance with (3) above.

(5)          That all other aspects of the 2007 Allowances Scheme be continued.

(6)          That, subject to the outcome of LGR, any future major review of the Scheme takes into account the aspects raised in paragraph 2.3 above in addition to other issues which may be identified, including the appointment of a Leader, or the adoption of a revised structure for the Council.

71       PROPOSED HADLEIGH COMMUNITY FACILITY – COMMUNICATIONS AND PR STRATEGY

The Chairman of Strategy Committee, Mr N A Ridley, introduced this item which was submitted for noting. 

The Strategy Committee at its meeting on 12 February 2009 considered the current position on the proposed development of a Hadleigh Community Facility, which has been agreed as a Council’s highest priority capital scheme.

The Committee had accepted the way forward recommended in Paper H198, including a proposed timetable and recognised the need for careful handling of the communication and public relations aspects and in particular the need to achieve clear public understanding of the key issues involved.  It was agreed that the Chief Executive in consultation with the Chairman of the Strategy Committee be authorised to develop a communication/PR strategy to secure effective delivery of the key messages of endorsement, if necessary, by the Council.

RESOLVED

That the position be noted. 

72       APPOINTMENT OF MEMBERS TO SERVE ON THE SUFFOLK JOINT SCRUTINY WORKING PARTY FOR FLOOD RISK

The Director of Corporate Services reported that Babergh District Council has been asked to appoint up to two Scrutiny Councillors to take part in a joint countywide Scrutiny Working Party for flood risk. 


RESOLVED

That Mrs S P Clarke and Mr L H Young be appointed to represent the Council on the Suffolk Joint Scrutiny Working Party for Flood Risk for the remainder of the current term of office or until such time as the working party has concluded its work, whichever is the earliest.

The business of the meeting was concluded at 11.50 a.m.
